Should I Divorce My Husband Because We Kissed Before Our Marriage?
Hanafi Fiqh
Answered by Ustadh Salman Younas
Question: My friend was married at a young age. Before the marriage occurred she sinned with her husband. Because of this she do esnot want to go back to him despite their daughter. She is afraid and does not want to disrespect Allah anymore.
Should she try to divorce him or is it permissible for her to go back to him?
Answer: assalamu alaykum
Your friend has repented from what she had done and the Prophet (God bless him) said, “the one who repents from sin is like one who did not sin at all.” [Ibn Majah] Similarly, Allah says in the Qur’an, “O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah.” (39:53)
In light of these texts, your friend needs to understand that she cannot let this past sin affect her life and marriage in such a negative manner. Despair of this sort is contrary to the teachings of our religion. What she has done in the past is the past for which she has sincerely repented. To contemplate divorcing her husband over this one slip after being married for a number of years with a child is something I would strongly advise against (unless there is something that I am unaware of). Rather, your friend is now married, her relationship with her husband is now a legitimate one, and her partner and child both have certain rights.over her that she should fulfill. These include, first and foremost, coming together as a family.
Of course, it is perfectly normal to feel remorse whenever we remember the sins we have committed. This is in fact a sign of faith. But it is also important to have hope in Allah after repenting and to not let sin detract us from our other responsibilities.
