Does an Explicit Statement Mistakenly Texted to the Wife Effects Divorce?

Hanafi Fiqh

Question

If a husband is explaining something to his wife and while explaining, he speaks in the first person singular and says that the company would say to his employee, “We need to separate.” Would such a sentence structure have any effect on their marriage, as the intention was merely to explain?

What would be the ruling here if the husband accidentally wrote an explicit statement on Whatsapp due to an auto-correction mistake (fast typing) and deleted that right after before sending it?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray you are in good faith and health. Thank you for your question.

These words and thoughts should be ignored. Sacred Law is not trying to trick people out of their marriages. There was no divorce in this case. Allah is Merciful and does not take His servants to task for what they have no control over. These are Satan’s tricks and obtrusive thoughts. Rest assured, there is nothing to worry about in both cases, my brother.

Remember Allah and seek refuge in Him through isti’adha (أعوذ بالله من الشيطان الرجيم). He is the Most Merciful, and His Mercy means that He will not take you to task for discrepancies that exist only in your mind. Find comfort in His Mercy, and do not let the devil distract you from Allah.
