Do I Need To Pay Expiation if I Fly Past the Miqat Without Ihram?
Hanafi Fiqh
Answered by Shaykh Yusuf Weltch
Question
While performing ‘umra from Uzbekistan, the plane flies directly through the Miqat Qarn al-Manazil and goes to Jeddah airport. Our intention will be first to go to Medina.
After that, we will go to Medina first by bus. From Medina, we wear Ihram at Dhul Hulayfah and go to Makkah with the intention of ‘umra. In this way, should we give a damm (sacrifice) for crossing the Miqat by plane?
Answer
In the Name of Allah, the Most Merciful and Compassionate
It is an obligation for anyone intending to perform the ‘umra to enter the state of Ihram when crossing the miqat, at any point. [Ibn Maza, al-Muhit al-Burhani]
If one does cross the miqat without entering the state of Ihram, a sacrificial slaughter is due as expiation. [Ibid.]
Returning to the Miqat
However, if one returns to any Miqat and enters into the state of Ihram, recites the Talbiya, and then crosses the Miqat in Ihram – the expiation falls off as they have made up for their previous violation. [Ibid.]
Hope this helps
