Can I Use Secretly Saved Money for Hajj Without Husband’s Knowledge?

Answered by Shaykh Yusuf Weltch

Question

I reserved a small amount of money without my husband’s knowledge for emergencies. After witnessing reckless expenditures, I decided to use this amount, though insufficient for major needs, to perform Hajj. Is this decision permissible?

Answer

In the Name of Allah, the Most Merciful and Compassionate

Transacting in your husband’s wealth without his explicit or understood consent is not permissible. [Maydani, al-Lubab fi Sharh al-Kitab]

If, however, your husband is not fulfilling your financial rights, you should speak with him candidly and respectfully and if he still does not fulfill your rights, you may take only what is due to you. This would not include Hajj as it is not his responsibility to pay for your Hajj. [Ibid.]
