Wife’s Guardian After Marriage
Wife’s Guardian After Marriage
What happens to the guardian (wali) of the wife after marriage? Does she need his permission to leave home (with her husband) if she lives with her father?
In the Name of Allah, the Most Merciful and Compassionate
May Allah guide every dimension of our lives to that which pleases Him
Husband’s Authority – Normal Circumstances
Upon marriage, a husband accepts the responsibility of caring for his bride from her guardian (wali). He also receives the authority with which the responsibility comes. Under normal circumstances, the wife only needs her husband’s permission. [Misri, ʿUmda Al-Salik]
Husband’s Authority Without Fulfilling Responsibilities
In this case, the fact that the woman lives in her father’s home means that her husband is not taking full responsibility for caring for her (nafaqa). As she is living in her father’s home, she has to obey her father’s house rules. If the husband refuses to accept this, he merely needs to fulfill his responsibilities and provide her with the lodging he owes her, Allah knows best.
