Husband’s Authority – Normal Circumstances


Upon marriage, a husband accepts the responsibility of caring for his bride from her guardian (wali). He also receives the authority with which the responsibility comes. Under normal circumstances, the wife only needs her husband’s permission. [Misri, ʿUmda Al-Salik]

Husband’s Authority Without Fulfilling Responsibilities


In this case, the fact that the woman lives in her father’s home means that her husband is not taking full responsibility for caring for her (nafaqa). As she is living in her father’s home, she has to obey her father’s house rules. If the husband refuses to accept this, he merely needs to fulfill his responsibilities and provide her with the lodging he owes her, Allah knows best.

He is the author of the text “The Musnad of Ahmad ibn Hanbal: A Hujjah or not?” He has served as the Director of the Discover Islam Centre and Al Jeem Foundation. For the last five years till present, he has served as the Khatib of Masjid Ar-Rashideen, Mowbray, Cape Town.

Shaykh Irshaad has thirteen years of teaching experience at some of the leading Islamic institutes in Cape Town). He is currently building an Islamic online learning and media platform called ‘Isnad Academy’ and pursuing his Master’s degree in the study of Islam at the University of Johannesburg.
