Would Hajj Badal be Acceptable for my Obligatory Hajj?
Hanafi Fiqh
Answered by Mawlana Ilyas Patel
Question
I am a 47 years lady with a low income, looking after my son, who has long-term physical disabilities. I have not been for my obligatory Hajj and would like to go, though I do not have the financial means.
However, my deceased elderly uncle and his wife (my maternal aunt, khala, who is alive) have not been to Hajj. My aunt would like someone to perform Hajj Badal for both of them. Can I go on their behalf? Would it also be acceptable for my obligatory Hajj?
Answer
In the Name of Allah, the Most Merciful and Compassionate
This is a noble intention to fulfill one’s Hajj.
Yes, you can perform Hajj if you have a husband or a mahram, unmarriageable kin, like your brother going along with you. However, as you haven’t done your own obligatory (fard) Hajj, it will be disliked (makruh) to do so, but valid. [‘Ala’ al-Din ‘Abidin, al-Hadiyya al-‘Ala’iyya]
May Allah Most High open up doors of his sustenance for you, enable ease of travel there and back with increased spirituality and closeness to Allah and love of His Prophet (Allah bless him and give him peace).
