Would My Son from a Previous Marriage Become Mahram of the Female Infant Whom My Wife Breastfeeds?

Answered by Mawlana Ilyas Patel

Question

If my wife, who has never been pregnant, naturally produces breast milk and breastfeeds a female infant and fulfills the conditions for establishing foster relations via milk nursing (https://seekers.flywheelstaging.com/answers/shafii-fiqh/how-much-milk-nursing-is-needed-to-establish-familial-bonds/), would that make my son from a previous marriage a mahram of the female infant who my wife breastfeeds? Additionally, would it make my father, grandfather, and brother mahrams of the infant in question? Jazakum Allah khairan.

Answer

In the Name of Allah, the Most Merciful and Compassionate

I pray you are in good faith and health. Thank you for your question.

No, it will not make your son a mahram to the female infant whom your wife breastfeeds, as he is from a previous marriage. However, the husband will become the foster father of the female infant. Also, it will make the father, grandfather, and brother mahrams to the infant. This is all subject to if the female infant ingesting the milk was less than 2.5 lunar years old at the time.

If a woman has breastfed a child, her husband will be the foster father of that child because he was the reason for her milk.
